1. Who We Are

Zeni Holdings, LLC, a Pennsylvania limited liability company, doing business as Pulse Business Finance and PBF Pulse ("Pulse," "we," "us," or "our"), provides fractional CFO, project-based CFO ("CFO Lite"), debt and growth capital advisory, and AI and technology strategy services to businesses.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit www.pbfpulse.com (the "Site"), use our online fit check assistant, submit a form, book a call, receive our emails, or otherwise interact with us online (together, the "Services"). Our contact information is in Section 18.

2. Scope

This Policy applies to visitors to our Site, prospective clients, referral partners, and people who receive our communications. Because our Services are directed to businesses, most personal information we collect relates to individuals acting in a professional capacity, such as business owners, executives, and advisors.

3.1 Information you provide to us

Please do not send us sensitive information through the Site. Our forms and fit check are not designed to receive Social Security or taxpayer identification numbers, bank or card account numbers, login credentials, tax returns, personal financial statements, health information, or confidential information about other people. If you become a client, we will provide a secure method for exchanging documents. If we receive sensitive information through the Site, we may delete it.

3.2 Information collected automatically

When you use the Site, we and our service providers automatically collect device and usage information, such as IP address, approximate location derived from your IP address (for example, city or state), browser and device type, operating system, referring web page, pages viewed, links clicked, and the date and time of your visit. We collect this information using cookies and similar technologies described in Section 6.

The "60-second fit check" on our Site is an automated assistant powered by artificial intelligence. It is not a person.

Cookies are small files placed on your device. We and our service providers also use similar technologies, such as pixels in emails, local storage, and scripts. We use them in the following categories:

Your choices. You can change your settings at any time through the "Cookie Preferences" link in the Site footer. Most browsers also let you block or delete cookies. You can prevent email tracking pixels from loading by disabling automatic image loading in your email program.

Global Privacy Control. If your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of any sale or sharing of personal information and of targeted advertising for that browser, and we do not load non-essential analytics or marketing cookies in that browser.

Do Not Track. There is no uniform standard for "Do Not Track" browser signals, and the Site does not currently respond to them. We honor GPC as described above.

Tracking across other websites. Other than service providers acting on our behalf as described in this Policy, we do not knowingly allow third parties to collect personal information about your online activities over time and across different websites through our Site.

7. How We Disclose Personal Information

We disclose personal information only as follows:

We may also use and disclose information that has been aggregated or de-identified so that it cannot reasonably be linked to you. We maintain de-identified information in de-identified form and do not attempt to re-identify it.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising or use it for targeted advertising. We do not disclose personal information to third parties for their own direct marketing purposes. We have not done any of these things in the past 12 months.

8. Marketing Communications

Email. If you contact us, subscribe, or have a business relationship with us, we may send you emails about our services, insights, and events. Every marketing email includes an unsubscribe link and our postal address, and you can also unsubscribe at any time through the "Email Preferences" link in the Site footer. We process opt-out requests promptly and in any event within 10 business days. After you opt out, we may still send messages related to an inquiry or engagement.

Text messages and calls. We use phone numbers to respond to your inquiry. We do not send marketing text messages or make autodialed or prerecorded marketing calls without your prior express written consent.

9. How Long We Keep Personal Information

We keep personal information only as long as reasonably necessary for the purposes described in this Policy, unless a longer period is required or permitted by law. Our general retention periods are:

We may keep information longer when needed to comply with law, resolve disputes, or preserve information subject to a legal hold. When information is no longer needed, we delete or de-identify it.

10. How We Protect Personal Information

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information we handle, including encryption in transit (HTTPS/TLS), multi-factor authentication on business accounts, access limited to people who need it, encrypted devices, and reputable service providers that maintain their own security programs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you and regulators as required by applicable law, including the Pennsylvania Breach of Personal Information Notification Act.

11. Your Privacy Choices and Rights

11.1 Rights we offer to everyone

We may keep information where the law requires or permits, for example to complete a transaction, maintain security, meet legal obligations, or establish or defend legal claims. If we cannot fully honor a request, we will explain why.

11.2 Additional rights under state law

Residents of states with comprehensive consumer privacy laws, currently including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, may have additional rights where those laws apply to us. These may include the right to know the categories and sources of personal information we collect and why; to receive a portable copy; to opt out of the sale of personal information, targeted advertising, and certain profiling; to limit the use of sensitive personal information; and to appeal our decision on a request. Some of these laws do not apply to businesses of our size or to information collected in a business-to-business context.

As described above, we do not sell personal information, engage in targeted advertising, or use profiling to make decisions that produce legal or similarly significant effects, and we do not use sensitive personal information to infer characteristics about you.

11.3 How to submit a request

Email privacy@pbfpulse.com with the subject line "Privacy Request," or call (484) 401-9238. To protect your information, we will verify your identity by matching information we already hold, for example by confirming the request from the email address we have on file. You may use an authorized agent; we will ask for your signed permission and may confirm the request with you directly. We will acknowledge your request within 10 business days and respond within 45 days. If we need more time, we will tell you why, and we may extend the period by up to 45 additional days where permitted by law. We do not charge a fee unless a request is manifestly unfounded or excessive.

11.4 Appeals

If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Appeal." We will respond within the time required by applicable law. If we deny your appeal, you may contact the Attorney General of your state.

We will not discriminate against you for exercising your privacy rights.

12. Additional Information for California Residents

This Section supplements this Policy and applies to California residents to the extent California law applies to us. In the past 12 months, we have collected the following categories of personal information. We collect it from the sources described in Section 3 and use it for the purposes described in Section 4. We have disclosed each category for business purposes only to the service providers and other recipients described in Section 7. We have not sold or shared any category.

Sensitive personal information. We do not intentionally collect sensitive personal information through the Site, and we do not use or disclose it for purposes that would give rise to a right to limit under California law.

Minors. We have no actual knowledge of selling or sharing personal information of consumers under 16.

"Shine the Light." We do not disclose personal information to third parties for their own direct marketing purposes.

Reviewing and correcting information. You may review and request changes to your personal information by contacting us as described in Section 11.3.

13. Nevada Residents

We do not sell covered information as defined in Nevada law. You may still submit an opt-out request to privacy@pbfpulse.com, and we will record it.

14. Children's Privacy

Our Services are intended for business professionals and are not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, please contact us and we will delete it.

15. Visitors Outside the United States

We are located in the United States, and the Site is intended for users in the United States. If you access the Site from another country, your information will be transferred to, processed, and stored in the United States, where data protection laws may differ from those in your country.

16. Third-Party Links and Services

The Site links to third-party websites and services, such as Google Calendar for scheduling and Google Maps for directions. When you use them, the third party's privacy policy governs its collection and use of your information. We are not responsible for their practices.

17. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy on this page and change the "Last Updated" date above. If we make material changes, we will provide a prominent notice on the Site or notify you by email before the change takes effect, where required by law.
